RESOLUTION NO. 2017-18
A RESOLUTION OF THE PELICAN RAPIDS CITY COUNCIL DECLARING MANDATORY WATER USE RESTRICTIONS.
WHEREAS, on May 30, 2017, the City of Pelican Rapids began a project to clean and paint the existing 500,000 gallon water tower, and
WHEREAS, the project entails taking the 500,000 gallon water tower off-line, removing it from the municipal water system; and
WHEREAS, the City of Pelican Rapids will continue to provide water for adequate and safe levels of potable water directly from the 5 (five) municipals wells and water treatment facility, and
WHEREAS, in order to avoid water shortages, while still providing for adequate and safe levels of potable water for delivery to water users and customers, and to ensure adequate fire suppression water and water pressure within the City’s system, mandatory water restrictions need to be implemented; and
WHEREAS, the adoption and implementation of mandatory water restrictions are necessary to preserve the public health and safety,
NOW, THEREFORE, BE IT RESOLVED BY THE PELICAN RAPIDS CITY COUNCIL effective immediately, the following mandatory water restrictions shall be adopted and implemented to govern the use of water delivered through the City’s municipal water system:
•“Outdoor water use,” for purposes of this resolution means use of treated water delivered through the City’s water system, includes, without limitation, watering or irrigation of any park, lawn, yard, garden, tree, shrub, landscaping, or other outdoor vegetation; washing of vehicles, boats, sidewalks, driveways, and patios; and filling or refilling of pools or hot tubs.
•Effective immediately, outdoor water use is restricted in accordance with the following schedule:
•Outdoor water use shall only be permitted between 06:00 p.m. and 12:00 a.m. on Tuesdays, Thursdays and Saturdays for EVEN NUMBERED ADDRESSES.
•Outdoor water use shall only be permitted between 06:00 p.m. and 12:00 a.m. on Wednesdays, Fridays and Sundays for ODD NUMBERED ADDRESSES.
•Outdoor water use is prohibited between 12:00 a.m. and 6:00 p.m. on Tuesdays, Wednesdays, Thursdays, Fridays, Saturdays and Sundays, and at all times on Mondays.
•The water restrictions set forth in this resolution shall not apply to any duly licensed person or company engaged in the business of growing or selling plants, trees or other live landscaping stock or vegetation. Commercial car washes are exempt from the water restrictions contemplated herein, unless further action is taken by the City Council.
•No bulk water sales from hydrants will be permitted.
•A person or business found to be in violation of the water restrictions set forth in this resolution shall be issued a written warning notice and will be required to immediately suspend or immediately correct their/its water use practices. A person’s or business’s failure to immediately comply with a warning notice, or subsequence violations, of the water restrictions, shall result in the issuance of citations.
•The outdoor water use restrictions set forth herein shall remain in effect so long as the water tower project is active, and until otherwise rescinded or modified by subsequent resolution adopted by the Pelican Rapids City Council.
•When the water restrictions are lifted, the City Clerk shall promptly post notice at City Hall and all officially designated posting locations within the City, that the outdoor water use restrictions contained in this resolution are no longer in effect.
•A person or business needing relief from the water restrictions implemented under this resolution may submit a written request for the same to the City Administrator, who may grant written exemptions therefrom, but only upon facts demonstrating significant hardship or special need, said significant hardship or special need to be determined solely at the discretion of the City Administrator.
•Notification of the imposition of water restrictions in accordance with this resolution shall be posted by the City Clerk at all officially designated posting locations within the City and published on the City website, www.pelicanrapids.com.
The motion for adoption of the foregoing resolution was introduced by City Council Member Ballard, duly seconded by City Council Member Holl, after full discussion thereof, and upon a vote being taken thereof, the following City Council Members voted in favor thereof: Ballard, Holl, Foster, Frazier
and the following City Council Members voted against the same: none.
